FIELD OF APPLICATION

The present General Conditions of Sale apply, without restriction or reserve, to any purchase of tickets offered for sale by the NOCTAMBUZZ company on its Internet site.
You are required to read them before purchasing a ticket. You are solely responsible for choosing to use NOCTAMBUZZ's services.
The head office of NOCTAMBUZZ is located at 61 rue du Chateau d'Eau - 75010 Paris.

Unless proven otherwise, the data recorded in NOCTAMBUZZ's computer system constitutes the proof of all the transactions that you conclude with NOCTAMBUZZ.
In accordance with the French Data Protection Act of January 6, 1978, reinforced and completed by the RGPD (General Data Protection Regulation) which came into force on May 25, 2018, you have the right to access, rectify, oppose, delete and port all of your personal data at any time by writing, by mail and proving your identity, to : NOCTAMBUZZ - 61 rue du Chateau d'Eau - 75010 Paris

You declare that you have read the present contract and accepted it by checking the box provided for this purpose before the implementation of the procedure for ordering your tickets. The validation of the ticket order materializes your acceptance, without restriction or reservation of this contract.
Finally, you acknowledge that you have the required capacity to contract and acquire the tickets offered on the NOCTAMBUZZ website.
This contract may be subject to subsequent modifications. In this case, the version in force on the day of your purchase will be applicable to the purchase.

ORDER

The registration of an order on the NOCTAMBUZZ website is realized when you accept the present General Conditions of Sale by checking the box provided for this purpose and when you validate your order. In application of the provisions of article 1127-2 of the Civil Code, the Client has the possibility to verify the details of his order, its total price and to correct possible errors before confirming his acceptance. This validation implies the acceptance of the entirety of the present General Conditions of Sale and constitutes a proof of the contract.

It is therefore your responsibility to check the accuracy of the order and to immediately report any errors.
The sale of the tickets will only be considered definitive after NOCTAMBUZZ has sent you confirmation of the acceptance of the order by e-mail and after receipt of the full price.

NOCTAMBUZZ reserves the right to cancel or refuse any order from a Client with whom there is a dispute concerning the payment of a previous order.

TICKET PRICES

The prices of the Tickets are indicated with mention of the currency and, depending on the case, exclusive of tax or inclusive of all taxes and, depending on the case, including or not including the rental fees and, if applicable, the management fees. When fees are excluded from the ticket price, they are presented at the beginning of the purchase process with the applicable taxes. All orders, regardless of their origin, are payable only in the currency indicated during the order process.

NOCTAMBUZZ reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the order is registered.

AVAILABILITY AND SEATING PLAN
You are informed, in real time, when you place your order, of the availability of the Tickets you wish to purchase.
If all or part of the Tickets in the desired category are unavailable, NOCTAMBUZZ will inform you and you will be able to purchase Tickets in another category, subject to their availability.
If the number of Tickets you request is greater than the number of Tickets available in your chosen category or in another proposed category, NOCTAMBUZZ may assign you non-contiguous seats.
In any case, you will be able to verify the adequacy of the order with your wishes at the time of the validation of the order.

PAYMENTS

For orders of paid Tickets, you must make your payments by credit card directly on the NOCTAMBUZZ Sites. NOCTAMBUZZ accepts credit card payments from the CARTE BLEUE / VISA and EUROCARD / MASTERCARD networks as well as from other networks mentioned during the payment stage. Your bank account will be debited with the amount of the order, as soon as the final validation of the transaction in the case of a secure CB Payment, except in the case where you are in deferred debit in which case this debit will be effective on your bank account at the end of the month. A proof of order will be automatically sent to you by e-mail as soon as the payment has been recorded. In order to be valid, the Ticket must not have been the subject of a stop payment or an unpaid credit card used for the order, in which case the bar code will be deactivated: you will then be unable to access the Event. The debit of the bank card is independent of the actual printing of the tickets. In any event, the Tickets will be paid even if the Customer fails to print them.

SECURING PAYMENTS

NOCTAMBUZZ uses all reasonably acceptable technologies to ensure that its online payment system is as reliable as possible. The confidentiality of banking information is guaranteed and secured by the SSL protocol which systematically checks the validity of access rights during payment by bank card and encrypts all exchanges.

ELECTRONIC TICKET

As soon as your order is confirmed, and unless otherwise stated at the time of ordering, you will receive an e-mail containing the digital ticket (in the body of the message or as an attachment) to be printed at home on A4 paper. Each Ticket has a unique barcode that allows you to access the Event. Only one person can access the Event with a Ticket. Therefore, in the event of loss, theft or duplication of a valid Ticket, only the first person holding the Ticket will be able to access the Event. You remain responsible for the use of your Ticket.

PRINTING CONDITIONS AND VALIDITY OF TICKET

This Ticket is only valid if printed on blank white A4 paper on both sides. The printing format must not have been altered, the printing must be of good quality and all the information contained on the Ticket must be legible. Printing may be done in black and white or in color.
Partially printed, soiled, damaged or illegible Tickets may not be accepted and will be deemed invalid by the Promoter. The Organiser may also accept other ways of presenting the Ticket: cell phone, tablet, etc. These possibilities may be presented, if necessary, during the ordering process.

USE AND VALIDITY OF THE TICKET

The Ticket is neither exchangeable nor refundable.
It is personal and non-transferable, unless expressly authorized. It is possible that the Organiser did not wish to make each of the Tickets nominative, in which case they will only bear the same identity, namely that of the purchaser indicated at the time of ordering. In any case, the Ticket may not be sold for a face value greater than that indicated on the Ticket.

NOCTAMBUZZ reserves the right to take legal action against Buyers who offer Tickets for sale at a price higher than their face value. The illicit sale of tickets for the Event (entry tickets, invitations, badges, passes, etc.) on the public domain, in a private place or on the Internet, is a criminal offence punishable by arrest by the police force and a fine of €15,000 (art. L 313-6 2 of the French Penal Code). The Ticket is only valid for the specific location, session, date and time of the Event. After the start time, access to the Event is no longer guaranteed: in this case, you will not be entitled to any refund. You are advised to arrive before the start of the Event, at least 30 minutes in advance.

Some of the times indicated by the Organizer may be strict deadlines without tolerance for late entry.
Any person who fails to comply with the rules and regulations and the T&Cs may be refused entry to the Event or expelled from the Event without being entitled to a refund of the ticket.

TICKET CONTROL AND ACCESS TO THE EVENT

The Organizer is responsible for ensuring the control of the Tickets unless it has delegated this task to a third party. It is the unique bar code and the Ticket identifier, if applicable, that will make it possible to verify the validity of each Ticket.
In the case of registered Tickets, the Organizer will always have the possibility to check your identity at the entrance of the venue where the Event is taking place. You will therefore need to carry a valid official form of identification with a photograph if you wish to enter the Event.
You must keep your Ticket or the standard double-sided Ticket that may have been given to you when you entered the Event by the Organizer for the entire duration of the Event.

You are reminded that the Organizer is not obliged to verify the identity of the person in possession of the printable Ticket at home, nor to verify the authenticity of the printable Ticket at home insofar as the copy of the printable Ticket at home cannot be detected with certainty. You are responsible for the safekeeping of your Ticket and may be denied access to the Event even if your name appears on the Ticket, in which case you will not be entitled to a refund.

FRAUD

It is strictly forbidden to reproduce, duplicate or counterfeit a Ticket in any manner whatsoever. The person who has reproduced the Ticket and the user of the copy of the Ticket are liable to prosecution. In case of loss or theft, NOCTAMBUZZ declines all responsibility for the illicit use of the Ticket. Any lost or stolen Ticket is neither exchangeable nor refundable. In case of loss, theft or duplication of the Ticket, please contact the Event Organizer.

WITHDRAWAL PERIOD, CANCELLATION AND REFUND

In accordance with article L.221-28 paragraph 12 of the French Consumer Code, Tickets are not subject to a right of withdrawal. All orders are firm and final.
A Ticket may not be taken back, exchanged or refunded, even in the event of loss or theft. A Ticket may be refunded only in the event of cancellation of the Event and only upon the decision of the Organizer.

BEHAVIOR DURING THE EVENT

You must comply with the Organizer's instructions when you are at the Event venue.
The Rules and Regulations of the Event may be consulted either directly on the website of the Organizer, or before entering the Event, or following its transmission by the Organizer by e-mail and prior to the Event.

RESPONSIBILITY - APPLICABLE LAW - MEDIATION

In accordance with the law n°2004-575 of June 21, 2004, article L 121-20 3 of the code of drink, NOCTAMBUZZ is responsible by right towards the consumer for the good execution of the obligations resulting from the contract concluded at distance. In this respect, NOCTAMBUZZ is responsible to you for the proper transmission of the Ticket and, if applicable, for the proper execution of the payment. The sales of Tickets referred to herein are subject to French law. In case of litigation, the French courts will have exclusive jurisdiction.

PERSONAL DATA

The personal data that you communicate to us are only used to enable the transaction to be carried out and to keep proof of it. This information also enables us to send you the Ticket(s) you have ordered and possibly to contact you, insofar as possible, in the event of cancellation or modification of the date, time or place of an Event for which you have registered. This information is, by default, the last name, first name, e-mail address and telephone number of the participant.
You have the right to access and rectify your personal data at any time with NOCTAMBUZZ concerning the data that it collects and keeps in the framework of its own obligations (art.34 of the law " Informatique et Liberté " of January 6, 1978). It is enough to make the request by mail to : NOCTAMBUZZ - 61 rue du Chateau d'Eau - 75010 Paris.
